By accessing and using GearGen.XYZ, a service provided by BaseForm Dev Corp., you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
GearGen.XYZ is a Software-as-a-Service (SaaS) platform provided by BaseForm Dev Corp. By subscribing to our service, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use GearGen.XYZ for the duration of your active subscription. This license is subject to the following terms and restrictions:
All rights, title, and interest in and to GearGen.XYZ remain the exclusive property of BaseForm Dev Corp. and its licensors. This license does not grant you any ownership rights to the software or service.
You agree to pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan.
Your subscription will automatically renew at the end of each billing cycle unless you cancel your subscription through your account management page or by contacting customer support at least 24 hours prior to the renewal date. You authorize BaseForm Dev Corp. to charge your payment method for the renewal term.
BaseForm Dev Corp. reserves the right to adjust pricing for the service or any components thereof in any manner and at any time. Any price changes will take effect following email notice to you.
Payments are non-refundable and there are no refunds or credits for partially used periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period.
The materials within GearGen.XYZ are provided on an ‘as is’ basis. BaseForm Dev Corp. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
In no event shall BaseForm Dev Corp. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on GearGen.XYZ, even if BaseForm Dev Corp. or a BaseForm Dev Corp. authorized representative has been notified orally or in writing of the possibility of such damage.
The materials, mathematical models, and calculation outputs appearing in GearGen.XYZ could include technical, typographical, or calculation errors. BaseForm Dev Corp. does not warrant that any of the materials, generated geometry, or data outputs on its website are accurate, complete, or current.
GearGen.XYZ is provided strictly as a preliminary design and estimation tool. The calculation results—including those referencing specific gear design standards must not be relied upon for final manufacturing, production, or safety-critical applications without independent verification.
It is your sole responsibility to have all designs, specifications, tolerances, and load capacities reviewed, tested, and validated by a qualified professional engineer prior to physical manufacturing or implementation. BaseForm Dev Corp. assumes no liability for manufacturing flaws, mechanical failures, property damage, or personal injury resulting from the use of, or reliance on, the software's generated data.
BaseForm Dev Corp. may make changes to the materials, algorithms, or formulas contained on its website at any time without notice.
BaseForm Dev Corp. has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by BaseForm Dev Corp. of the site. Use of any such linked website is at the user’s own risk.
BaseForm Dev Corp. may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Service.
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You irrevocably submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia for the resolution of any disputes.
Your use of GearGen.XYZ is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. Our Privacy Policy details how BaseForm Dev Corp. collects, uses, and protects your personal information, your gear calculation inputs, and how data is securely processed through third-party payment gateways such as Stripe. By using the service, you consent to the data practices described in the Privacy Policy.
